Civil Justice Council call for evidence on enforcement

On 11th July 2024, the Civil Justice Council’s Enforcement Working Group launched a Call for Evidence, which will close on 16 September at 11:59pm.

Responses should be submitted by PDF or word document to CJCEnforcementCfE@judiciary.uk

Please use the Word document template for your response and name your submission as follows: ‘name/organisation – CJC Enforcement CfE’.

As part of the process, the working group will be holding three webinars via Microsoft Teams. The format of each webinar will be the same.

We encourage all our clients to take part and have their say. If you support the call for changes to the High Court and County Jurisdiction Order 1991, please include this within your responses.

There are four main areas to the call for evidence:

  1. Your experience and awareness of enforcement, including any barriers people face when enforcing a judgment, which method they find most/least effective, any amendment that should be amended to make them more appropriate for modern litigation
  2. Supply of information about potential judgment debtors, how to encourage greater engagement, how effective orders to obtain information are, sanctions for non-compliance, safeguards and should the creditor be given access to information held by third parties such as banks
  3. Support for debtors, what additional support particularly vulnerable debtors may need, the most effective way of disseminating information to debtors, should the court provide a telephone advice service, or other access to free advice through third parties to potentially facilitate early resolution?
  4. Any proposed improvements and changes to the system of enforcing judgments, how to make enforcement more accessible, fair and efficient, how to encourage debtors to engage in the court process early as the majority of debt judgments are judgments in default
